General Policies and Waivers for Participation in the Social Motion Program

I. Liability Release and Waiver
PLEASE READ CAREFULLY! THIS DOCUMENT AFFECTS YOUR LEGAL RIGHTS!
This release and waiver of liability is executed upon enrollment in favor of Spectrum Linx Foundation (SLF), which operates the Social Motion program and related activities.
The undersigned (“Registrant”) wishes to participate in SLF’s Social Motion program, including but not limited to classes, community outings or other activities as may be scheduled. The Registrant hereby freely, voluntarily, and without duress executes this Release and Waiver under the following terms:
GENERAL RELEASE AND WAIVER: The Registrant releases and forever discharges SLF and its employees, contractors, agents, officers, directors, successors, and assigns (collectively, “SLF”) from all liability, claims, and demands that may arise from the Registrant’s activities. This includes claims for bodily injury, illness, death, or property damage, whether caused by negligence or otherwise. The Registrant understands SLF does not provide financial assistance or medical, health, or disability insurance coverage.
INDEMNIFICATION: The Registrant agrees to indemnify and hold SLF harmless from any and all liability, losses, damages or illness arising from participation, whether caused by the acts of the Registrant or the negligence of SLF. This obligation survives the termination of this agreement.
MEDICAL TREATMENT: The Registrant releases SLF from any claims arising from first aid or medical treatment received during participation.
II. Assumption of Risk
The Registrant understands participation may involve physical activity and inherent risks, including participation in classroom activities, participation in community based outing activities, activities with peers, and exposure to foods and illness. The Registrant voluntarily assumes all risks and releases SLF from liability for any resulting injuries, illness, or property damage.
III. Insurance
The Registrant understands SLF does not provide health, medical, or disability insurance and is encouraged to obtain their own coverage.
IV. Confidentiality
The Registrant agrees to maintain the confidentiality of any personal, programmatic, or financial information related to SLF, its staff, clients, and donors.
V. Non-Solicitation of Clients and Personnel
The Registrant agrees not to solicit or hire SLF staff or contractors for employment or services, nor to solicit, recruit, or engage SLF clients, students, or their families in any activities that are in direct conflict with SLF’s programs, services, or operations — including, but not limited to, offering or promoting competing social skills programs or social groups — during their participation and for a period of two (2) years thereafter, without SLF’s prior written consent.
For purposes of this provision, “direct conflict” includes, for example, providing or advertising social skills training, social groups, or related services to SLF clients that overlap with or compete against services offered by SLF within the same geographic area or targeting the same client population. VI. Truth in Statements Provided
The Registrant affirms the accuracy and completeness of all information submitted to SLF. Misrepresentations may result in immediate termination from the program.
VII. Safety and Security
Spectrum Linx Foundation (SLF) is committed to providing a safe, positive, and inclusive learning environment for all participants in the Social Motion program. To maintain this standard, SLF reserves the right to dismiss any participant whose behavior compromises safety, endangers themselves or others, or disrupts the classroom environment.
If a registrant acts in a manner that is dangerous to themselves, other participants, staff, or volunteers—or if their behavior creates repeated disturbances that prohibit the class from functioning effectively—they may be asked to leave the class or event. Continued enrollment or future participation may be terminated at the sole discretion of SLF. (See refund policy.)
SLF retains sole discretion in determining whether a participant’s behavior is incompatible with the goals and expectations of the program. In such cases, SLF reserves the right to deny service or terminate enrollment without further obligation. These policies exist to ensure that SLF can provide a supportive and effective program environment for all participants.
VIII. Consent to Treat for Emergency Care
The Registrant authorizes emergency medical care as deemed necessary and agrees to cover all resulting expenses. SLF is indemnified against any claims arising from such care.
IX. Photo and Media Release
Unless otherwise determined, I consent to the use of digital, print, or other media—including but not limited to photographs, video, audio recordings, and social media posts—that feature the participant’s likeness, image, voice, and/or reference to or description of the participant’s disability. These materials may be used by Spectrum Linx Foundation (SLF) and its Social Motion program for purposes including, but not limited to, publicity, public relations, fundraising, marketing, promotional campaigns, and other similar activities.
I understand that I waive all rights, interests, and claims to compensation or ownership in such materials and that SLF may use these materials without further notice or approval.
If you do not agree to grant this permission, you must notify SLF in writing. Please send a specific denial of consent via email to asherali@socialmotionskills.org for inclusion in your registration file.
X. Equal Opportunity Provider
SLF provides services without regard to race, religion, national origin, sexual orientation, or gender identity.
XI. Participation and Active / Inactive Status
Participation in the Social Motion program, operated by Spectrum Linx Foundation (SLF), represents a commitment to personal growth and group development. Regular attendance and engagement are critical to ensuring that participants benefit fully from the program and contribute positively to the learning environment.
Participation: When you enroll in the Social Motion program, you are expected to support the group with consistent attendance and active involvement. Your presence is important—not only for your own progress but also for maintaining a dynamic and interactive group experience.
Active / Inactive Status: Participants are expected to maintain regular communication and participation. If a participant is absent for three (3) consecutive sessions without prior communication or explanation, SLF will attempt to contact the participant or their guardian. If contact is not re-established and no valid reason is provided, the participant may be moved to inactive status at SLF’s sole discretion. In such cases, the participant’s spot may be reassigned to someone on the waitlist.
Reinstatement to active status is not guaranteed and will be evaluated based on space availability and program compatibility. These policies are in place to ensure fairness and access for all participants who are committed to active involvement.
XII. Class Availability
Class sizes and locations are limited. A non-refundable deposit may be required to secure placement.
XIII. Programs, Classes, Times, and Locations
Schedules may change due to unforeseen circumstances such as weather or teacher illness. SLF will make reasonable efforts to notify participants via the contact information provided.
XIV. Teacher Background Checks
All instructors undergo background checks in compliance with state laws to ensure safety.
- Volunteers and Visitors
Participants acknowledge that volunteers and visitors may be present, even if background checks cannot be completed.
XVI. Payments, Refunds and Extended Absences
Full payment for term classes is due prior to the class start date unless partial or monthly payment options have been arranged in advance. Regardless of the payment method, the obligation for the full semester tuition remains in effect. Monthly payments are due as scheduled and must be paid in full.
Missed classes will not be refunded.
If a participant withdraws for cause, Spectrum Linx Foundation (SLF) must be notified in writing or by email to asherali@socialmotionskills.org. The date of written notice will be considered the official withdrawal date. Any refund or outstanding balance will be calculated based on that date. If the participant is on a monthly payment plan, the amount already paid may not match the prorated amount owed or refundable; adjustments will be made accordingly to settle the final withdrawal balance.
If SLF terminates enrollment, a prorated refund will be issued for the remainder of unused classes in the session.
Extended Leave of Absence:
Families who need to leave the program for more than two (2) weeks but intend to remain enrolled and return after their absence must coordinate with SLF management in advance to request an Extended Leave of Absence.
Such requests will be reviewed on a case-by-case basis and are subject to several factors, including program location, session timing, available notice, and other operational considerations. Approval of an Extended Leave is at the sole discretion of SLF and is not guaranteed.
Extended Leave of Absence may be considered in circumstances such as:
- Overseas travel
- Extended illness or medical treatment
Options for handling Extended Leave may include freezing your account or formally withdrawing and re-enrolling at a later date, subject to availability.
Extended Leave is not appropriate for temporary scheduling conflicts, extracurricular activities, or other convenience-based absences.
XVII. Attendance and Timing
Participants should arrive within 15 minutes of class start time. Late pickups (15 minutes after the scheduled end of class) may result in a prorated fee of $100/hour.

XIX. Other
Name Changes and Use of Pronouns in Classes
To ensure clarity and consistency in addressing students, the following policy applies to all requests for name changes and/or preferred pronouns in classroom settings:
- Students under 18: Parents or legal guardians will be notified of any request to use a different name or pronouns. Staff will follow the instructions provided by the parent or legal guardian.
- Students over 18 with an appointed guardian: The guardian will be notified of any request to use a different name or pronouns. Staff will follow the instructions provided by the guardian.
- Students over 18 without guardianship: Student requests for name and pronoun changes will be honored to the extent possible, in a respectful and confidential manner.
This agreement is governed by the laws of the State of Texas. If any part is deemed invalid, the remainder shall still be enforceable. The agreement binds the Registrant and their heirs, legal representatives, and assigns.
Electronic registration or participation is considered agreement to these terms.
XX. Parent and Program Information
At the beginning of each class term, SLF provides general information to parents and guardians regarding program logistics. This includes how to contact teachers, site coordinators, and program administrators in the event of questions, concerns, or emergencies.
